Hiring a Victory Disability attorney for your Social Security Disability Insurance (SSDI) claim or appeal can increase your chances of winning your case –And it’s a more affordable option than many folks believe! 

 

Below we’ll break down the cost of hiring a Victory Disability attorney and cover the most frequently asked questions related to Attorney Fees.

The fee agreement

Victory Disability is paid on a contingency fee basis. Meaning, we are only paid if we are successful in winning your claim. The contingency fee is the only authorized method for Disability attorneys to be paid under Social Security’s rules and we follow those rules strictly. 

Our legal services cost nothing upfront, and nothing if we don’t win your case.

If we are successful in winning your case, our firm receives 25% of the back pay, or the cap which the Social Security Commissioner sets (currently $7,200) – Whichever amount is less. 


As an example, if your back pay is $1,000, Victory’s fees would be 25% ($250) because $250 is less than $7,200.

  

If your back pay were to be $100,000, Victory would be capped at $7,200, and not 25% (which would equate to $25,000).

  

Again, there is no cost unless we are successful in winning your claim!

Back pay is the money that accumulates while a claimant’s case is being reviewed by Social Security. 

 

Once your SSDI claim is approved, the SSA will determine your monthly benefit amount. This amount is based on your prior earrings. From there, Social Security will compensate you for the months between the onset of your disability, or your disability application date, to your approval date.

Back pay is capped at a maximum of one year and paid in one lump sum. 

The contingency fee for your SSDI attorney is automatically deducted from your back payment by the SSA. In most cases, there is no direct payment required from you to our firm. The back pay check that you receive in the mail will show this reduction. 

Moving forward, you will begin to receive your regular monthly SSDI payment from Social Security. There is no additional payment required to Victory after this one time fee. 

In the rare scenario, that there is no back pay awarded in your case but we are successful in winning your claim, Victory must file what’s known as a fee petition. 

 

A fee petition is basically an accounting of all the work we performed on your case, broken down into hours.  We submit this detailed accounting to Social Security, who then determines what a fair fee would be for the work performed.  They will then send this to you and ask if you agree with the determined fee.  If all parties agree, then generally, we will come up with a payment plan with our client that will allow them to pay the fee but also not put them in any undue financial hardship.
